Terms of Service

These Terms of Service ("Terms") govern access to and use of the Smidi platform provided by Nidaros Koding ("we", "us", "our"). By accessing or using Smidi, you agree to these Terms. If you use Smidi on behalf of a business, you represent that you have authority to bind that business.

Smidi is a software platform that helps appointment-based businesses operate online booking, client management, staff scheduling, and related salon website features.

We may update, improve, or discontinue features over time. We do not guarantee that any particular feature will remain available indefinitely.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You must provide accurate information and keep account details up to date.

We may suspend or terminate access if we reasonably believe these Terms have been violated or if necessary to protect the platform, users, or third parties.

If you operate a salon or business on Smidi, you are responsible for your public website content, pricing, availability, appointments, communications with your customers, and compliance with laws applicable to your business (including marketing and privacy obligations toward your customers).

You must not use Smidi to process unlawful content, infringe third-party rights, or misrepresent your services.

You must not attempt to bypass security, access another tenant's data, interfere with platform operation, scrape or overload systems, or use the service for spam or abusive communications.

We may investigate suspected abuse and take appropriate action, including rate limiting, suspension, or termination.

We aim to operate Smidi reliably, but the service is provided on an "as is" and "as available" basis unless otherwise agreed in a separate written contract.

We do not commit to specific uptime percentages, response times, or uninterrupted availability in these Terms.

Commercial pricing, subscriptions, and payment processing may be introduced or changed in future releases. These Terms do not describe payment-provider terms, invoicing mechanics, or refund policies unless separately published.

Nidaros Koding owns the Smidi platform, software, branding, and documentation, except for content you or your salon upload or configure.

You retain ownership of your salon content and grant us the rights necessary to host, display, and process it to provide the service.

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from use of the service.

Our aggregate liability for claims relating to the service is limited to the amount you paid us for the service in the twelve months before the claim arose, or zero if no fees were paid, unless mandatory law requires otherwise.

You agree to indemnify and hold us harmless from claims arising from your content, your use of the service, or your violation of these Terms or applicable law, except to the extent caused by our wilful misconduct.

Our Privacy Policy at getsmidi.com/privacy describes how we process personal data for platform operations. Salon privacy practices toward their customers are separate.

These Terms are governed by Norwegian law, without regard to conflict-of-law rules.

Disputes shall be subject to the exclusive jurisdiction of the Norwegian courts, unless mandatory consumer protection law requires otherwise.

We may update these Terms from time to time. Updated Terms will be posted at getsmidi.com/terms with a revised date. Material changes may require additional notice where required by law.
